• Competition Terms and Conditions Participating Refresh Renovations Licensees Only (the Promoter) of Refresh Renovations New Zealand (Licensor) is providing a Competition with a value of up to $10,000 (NZD) renovation prize for the 2023 Auckland Home Shows (as per the Promotional Period). By entering the Competition, you (the Participant) agree to be bound by the following terms and conditions: 1. Information on How To Enter and the Prize is deemed to be accepted by the Participant upon participating in this Competition. 2. Subject to clause 16.1, the promotional period for the Competition starts at 10:00am Thursday 20 April 2023 and ends at 6:00pm Sunday 10 September 2023. 3. The Competition is open only to New Zealand residents who are 18 years old and above. The Promoter’s employees and their immediate family members are not eligible to participate. 4. Only the person who originally entered the Competition can be awarded the Prize (the Winner). No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf. 5. The total Prize is valued up to $10,000 NZD inclusive of GST, to be provided in the form of products and services at the Promoter’s discretion. 6. The Prize is not transferrable or redeemable for cash. 7. Any products or services supplied by the Promoter or any third parties: 7.1. Shall be defined as follows: 7.1.1. For the Promoter, Concept Design services in accordance with its usual Refresh 5-step process including project management, administration and pricing up to the value of $1,500 NZD (GST inclusive) 7.1.2. For Blacktan Design Limited, concept plan services (at the discretion of Blacktan Design Limited) up to the value of $1,500 NZD (GST inclusive) 7.1.3. For Robertson Bathware, products at RRP from its Elementi range only but excluding any of its BARE concrete range, up to the value of $5,000 NZD (GST inclusive); 7.1.4. For Tile Depot, products at RRP, up to the value of $2,000 NZD (GST inclusive) 7.2. are not transferrable for cash and no change will be given. 7.3. In the event that the Prize specified in the Competition becomes unavailable for any reason the Promoter may substitute a prize of like or equal value.; 7.4. Subject to clause 10, must be redeemed within 12 months from the end of the Promotional Period; 8. The Prize is strictly conditional upon the Participant entering into a Concept Design agreement for a confirmed project through a participating Refresh Renovations Licensee. The project must be located within a franchisee territory (as defined by the Licensor from time-to-time) of a Participating Licensees in either Rodney, North Shore, West Auckland, Auckland and South Auckland only (Designated Territory). 9. A random draw will be performed by a representative of the Promoter (the Judge) at noon Friday 8 September 2023. Any entry drawn that is not within the Designated Territory shall be void and the draw performed again until an eligible entry is drawn. 10. The Winner will be notified in writing by email or by phone not later than 5:00 pm on Friday 18 September 2023 and must be available for the preparation of all publicity that may be required by the Promoter. Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another winner. If, after successful notification, the prize is not collected within two months of being announced it will be regarded as forfeit. (Note: 3 attempts to contact the Winner will include individual calls to any numbers provided at the time of entry.) 11. The Promoter reserves the right to disqualify any entrant who submits an entry or registration that is not in accordance with these Terms and Conditions. 12. The Winner takes the Prize entirely at his/her own risk and indemnifies the Promoter in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or other costs that may be associated with the Prize. Where the Prize has associated terms and conditions the Winner accepts the Prize subject to those terms and conditions and restrictions. 13. The Promoter may modify, suspend, terminate, or cancel the promotion if required, subject to any written directions from a regulatory authority. 14. The Promoter's decision is final and no correspondence will be entered into. 15. The Promoter is restricted to participating Licensees only of Refresh Renovations New Zealand. How to Enter 16. To participate in the Competition, individuals must follow the steps below, during the promotional period: 16.1. Purchase a ticket (either online or at the entry gate, in accordance with the terms and conditions of EENZ) and attend the Auckland Home Show, located at ASB Showgrounds, 217 Greenlane Road West, Greenlane, Auckland, on either one of the following relevant Auckland Home Show days (between Thursday 20 April 2023 and Sunday 23 April 2023 and between Thursday 7 September 2023 and Sunday 10 September 2023) (the Promotional Period) 17. Ensure their e-Ticket or Door Ticket is scanned at the entry point by a registered ticket scanner at the Refresh Renovation stand or complete the Competition manual form at the stand. 18. By entering this Competition, the Participant acknowledges that they will be added to the Refresh Renovation database and any other databases associated with Refresh Renovations New Zealand. The Participant may opt-out at any time. The Promoter’ Responsibilities 19. The Promoter reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason. 20. The Promoter takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Force Majeure or otherwise. 21. To the fullest extent permitted by law The Promoter will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the prize. 22. Where the Prize is to be supplied by an entity outside the Promoter’s control and that entity fails, for whatever reason, to supply the prize, the Promoter has no responsibility for the provision of the Prize and is not obliged to provide an alternative Prize or to take legal action to require the Prize supplier to provide the Prize. Acceptance 23. Participation in the Promotion is deemed acceptance of these Terms and Conditions. 24. If the Winner does not accept these Terms and Conditions the prize will be forfeited.
